The Kansas Equal Access Act (SB 92) would legalize medical marijuana for anyone whose safety, physical health, or mental health is at risk due to a temporary or permanent illness or injury.
This broad reaching bill is exactly what the majority of Kansans are expecting their lawmakers to pass this year. Instead of expressly limiting who can qualify, the Kansas Equal Access Act gives just about every type of patient in the state access to medical marijuana.
Unlike the Kansas Medical Marijuana Regulation Act, this bill does not limit the forms of consumption. Smoking and vaping cannabis would be legal under the KEAA.
Patient license fees would be $25 but would be waived if the applicant is disabled or receives KanCare assistance. The bill caps taxes on cannabis retail sales at 4%. Revenue generated from the state’s medical marijuana program would go towards such things as mental health programs, public school health programs, broadband internet initiatives, and property tax relief. This is a fiscally conservative bill that would reduce the government’s reliance on taxpayers.
The bill affords Kansas patients many protections. The only thing more popular than weed in Kansas is the Second Amendment. Kansas medical marijuana patients would have their gun rights protected under this Act.
Other protections given in this legislation:
Property buyers and renters would be protected from being denied based on their cannabis consumption.
Insurance companies could not drop or deny your coverage.
Students could not be expelled or banned from school or extracurricular activities if they consume medical cannabis. It could be consumed on school premises if done so by ways other than smoking or vaping.
State welfare benefits could not be revoked or denied.
Kansans have repeatedly sounded their support for medical marijuana. The Kansas Equal Access Act should be passed by the Kansas legislature. This measure allows Kansans to take control of their health with a wide variety of THC therapies. It also allows patients to grow their own medicine (up to 3 plants). It protects Constitutional rights and prevents anyone from retaliating against you for choosing to medicate with a natural plant.
